TERMS & CONDITIONS 

1. Applicability  

These Terms & Conditions apply to all offers, options, bookings and agreements made through The Pack Models, a model agency based in the Netherlands (“The Pack Models’’, “we”, “us”), acting as intermediary between the client (“Client”) and model (“Model”).  

Any terms used by the Client are excluded unless explicitly agreed in writing.  

2. Options & Bookings  

2.1 An option grants the Client a temporary priority right to book a model for a specific date. 

2.2 Options must be confirmed as a booking no later than 24 hours before the start time, unless agreed otherwise in writing. If not confirmed, the option automatically expires.  

2.3 Bookings take precedence over options. If multiple options exist, the first option holder will be given the opportunity to confirm. If they cannot confirm, the client holding the second option will be given the right to confirm the booking.  

3. Rates & Fees  

3.1 Rates are determined by The Pack Models and charged per:  

hour (exceptionally),  

half day (4 hours),  

full day (8 hours / 10 hours for commercials or film),  

overtime.  

3.2 All rates are exclusive of VAT and exclusive of a 20% agency commission, unless stated otherwise.  

3.3 Overtime is rounded up to full hours. Work performed between 00:00 and 08:00 is   charged at double the standard hourly rate.  

3.4 Fittings, rehearsals or similar preparation work are charged at 50% of the hourly rate for the first two hours, thereafter at the full hourly rate.  

4. Travel & Expenses  

4.1 Travel, accommodation and related expenses are fully payable by the Client.  

4.2 Travel time may be charged at 50% of the hourly rate, unless a full day booking applies or agreed otherwise.  

4.3 International bookings require full reimbursement of all travel-related costs.  

5. Usage Rights  

5.1 The agreed fee includes usage rights only as specified in writing between The Pack Models and the Client (including emails, quotations or booking confirmations). 

If no specific usage has been agreed in writing, the fee shall be deemed to include standard usage rights limited to online use on the Client’s own website and organic social media channels only, for a maximum period of six (6) months, within the Netherlands. 

Any other use requires prior written approval and may involve additional fees. 

5.2 Any additional or extended use, including extra media, countries, duration, campaigns, packaging, billboards, exclusivity, lingerie or swimwear, may result in additional fees.  

5.3 Nude or explicit content is not permitted unless explicitly approved in writing in advance by both the Model and The Pack Models.  

6. Unauthorized Use  

Any use outside the agreed scope without written approval is strictly prohibited. In case of unauthorized use, the Client owes a penalty equal to three (3) times the applicable fee, without prejudice to further claims.  

7. Artificial Intelligence (AI)  

7.1 The use of any material featuring a Model for AI-training, synthetic media, digital avatars, deepfakes or biometric analysis is strictly prohibited.  

7.2 Any AI-related use requires prior written consent and additional compensation.  

8. Cancellation  

Cancellations must be made in writing. The following fees apply regardless of reason:  

No fee: ≥ 48 hours before booking (NL-based models) / ≥ 72 hours (international)  

50% fee: 48–24 hours before booking  

100% fee: within 24 hours or on the booking date  

For multi-day bookings, the notice period equals the booking duration, with a minimum of two working days.  

9. Weather-Dependent Bookings  

If explicitly agreed as weather-dependent:  

first cancellation is free,  

second cancellation: 50% of the fee,  

thereafter: 100% of the fee.  

10. Payment  

10.1 Invoices must be paid within 30 days of the invoice date.  

10.2 Usage rights become valid only after full payment has been received.  

10.3 Late payments may incur statutory commercial interest and collection costs.  

11. Complaints  

Any complaint must be reported immediately and in writing. If justified, the Model must be dismissed immediately.  

12. Liability  

12.1 The Pack Models is not liable for damage unless caused by intent or gross negligence.  

12.2 Any liability of The Pack Models shall in all cases be limited to the total fee invoiced and paid by the Client for the relevant booking, excluding VAT. 

12.3 The Client indemnifies The Pack Models and the Model against third-party claims arising from the booking.  

13. Governing Law  

These Terms & Conditions are governed by Dutch law. Any disputes shall be submitted to the competent court in Amsterdam.
